Texas Government Code Chapter 423 and Local Government Code 229.001 bar cities and counties from regulating drone airspace, registration, or licensing; local control is limited to takeoff and landing on property they own.
Section 423.0045 bans drone flight below 400 feet over critical infrastructure facilities such as refineries, chemical plants, and pipelines, a Class B misdemeanor.
Chapter 423 makes it a Class C misdemeanor to use a drone to capture an image of a person or private property with intent to conduct surveillance.
The Fifth Circuit upheld Chapter 423 in 2024 and the U.S. Supreme Court denied review that October, so the statute remains fully enforceable statewide.
Houston: Houston bars drone takeoff and landing in city parks such as Hermann Park, Discovery Green, Buffalo Bayou Park, and Memorial Park without a Parks and Recreation Department permit.
Houston sits under overlapping Class B airspace from Bush Intercontinental and Hobby airports; LAANC authorization is available and required before flying in either ring.
